SPASA has become aware of changes required to the Queensland Contract to improve compliance with the regulations and enhance enforceability. These changes come as a result of the ever-changing legal landscape in our industry.
SPASA has reviewed the SPASA Queensland Contract and an updated contract will be available for members as soon as possible in both digital and print formats that addresses these changes.
In the interim, the SPASA’s Queensland contracts has been temporarily removed from the member portal, and we recommend that Members delay using this version of the contract in any form (print or digital) until we provide members with further advice.
If you’re using a pre-populated contract link of the SPASA Queensland contract, please note that this will also be unavailable temporarily.
SPASA will be providing members with existing contracts a single page insert that must be included at the start of the Contract for all versions of the Queensland Standard Contracts. This page addresses the necessary updates required by clearly defining the elements of the Contract Schedule and clearly outlining and explaining the clauses in the Contract which can change the price, as required by S14(6) of Schedule 1B, Part 2, Division 1, of the Queensland Building and Construction Commission Act.
Once available, the PDF of this insert page can be printed and inserted into your hard-copy contract after the contents page, and before the Information Table.
The fully-updated digital contract will be made available through the member portal as soon as possible. New printed contracts will also be available as soon as possible.
The Queensland Master Pool Builder contract is also impacted by this update and therefore is currently not available in the member portal.
