WA - Consultation - Review of home building contract laws

August 27th, 2025

WA - Review of home building contract laws

The WA Department of Building and Energy is undertaking a review of home building contract laws and they are seeking input from industry. Swimming pool contracts are captured by these laws, so SPASA will be preparing a submission on behalf of members and we are keen to gain your insights.

The review aims to consider the Home Building Contracts Act 1991 (except Part 3A); and the dispute resolution/complaint process in Parts 2 and 3 of the Building Services (Complaint Resolution and Administration) Act 2011. The Government is seeking to ensure that people who are building or renovating their homes or pools are adequately protected and to build confidence in the building industry.

Building and Energy has released an online survey for consumers and homeowners. A separate survey is open for builders and owner-builders.

We encourage SPASA members to provide feedback on your recent experiences and have your say on any improvements you would like to see to the legislation.

The survey is open until 12 September 2025.
