The WA Government announced amendments to the Notice for the Home Owner (the Notice).
The Notice is required to be included with a home building work contract entered into in Western Australia where the value of the works is $7,500 but not more than $500,000. It outlines the home-owner’s rights and obligations under the Home Building Contracts Act 1991, and can assist them with understanding their building contract.
These amendments take effect from 1 September 2025. From this date, builders must provide homeowners with a copy of the updated Notice.
What are the changes?
Minor amendments have been made to the prescribed form of the notice to update references to reflect existing requirements in the Act. These amendments also include amended contact information and modernised language.
How does this impact SPASA members and contracts?
The Notice doesn’t form a part of the contract, but is generally supplied to the homeowner at the same time as the contract. The new Notice will need to be supplied with the contract.
What should SPASA members do?
Notices in contracts that have already been entered into are unaffected as the updates made reflect the existing requirements of the Act.
For contracts being entered into on-or-after 1 September 2025, members should remove or strike out the superseded Notice and include a copy of the updated Notice with their contract.
