MBIE - Changes to the warning notice for pool manufacturers and retailers

Manufacturers and retailers of new pools must supply notices informing consumers that the pool must have barriers that restrict access by young children.

A new Building (Pool Manufacturers and Retailers) Warning Notice has been approved by Gazette notice on 28 March 2025. A period of 18 months has been provided between the date for commencement of the 2025 warning notice and the revocation of the 2017 notice to allow time for the sector to adopt the change. SPASA was part of the consultation process for the 2025 notice.

During this time both versions of the notice will be approved, providing you with time to make necessary changes and enabling use of the 2025 notice where possible.

Updates to the current notice include:

  • making the wording clearer and easier to understand

  • clearly stating the drowning risks to young children posed by pools

  • reducing the number of notices required

  • changing the display requirements

  • introducing requirements for notices to be displayed on any webpage selling pools in Aotearoa New Zealand.
