Warning!
Unlike house construction, most sites
for swimming pool/spa constructions are at homes already occupied
by a family with other families living close by. Construction sites
are dangerous places and extra care should be taken at all times
in respect to children, visitors and pets.
Contractually, and also in accordance with the
Building Services Authority’s
recommendations and accepted Industry practice before commencing any
work under a contract, a Contractor must effect with a reputable insurer
(and must maintain during the performance of the Contract), Contract
Works and Public Liability Insurances in the names of the Owner and
the Contractor for their respective rights and interests.
Such Contract Works Insurance must:
- be for the full insurable value of the work under the Contract; and
- extend until 4pm on the Date of Practical Completion.
- Such Public Liability Insurance must:
- cover the liabilities of the Contractor and the Owner to third parties
in respect of personal injury, death or damage to property arising out
of or in connection with the work under the Contract; and
- provide cover in an amount of ten million dollars ($10,000,000) for
any one occurrence.

with SPASA members in Queensland, SPASA in conjunction with Commercial
and General Insurance Brokers Pty Ltd has arranged with QBE MERCANTILE
MUTUAL for WaterWorks "Contract Work" and "Public Liability"
Insurances for Customers of SPASA Member Contractors in Queensland.
In summary, the benefits of WaterWorks Insurance for you are:
- WaterWorks Insurance will insure both you (as the Resident Owner) and your SPASA Member Contractor for your respective rights and interests in the full insurable value of the work required under your Contract, at the construction site, from the Commencement Date “on site” to 4pm on the Day of Practical Completion & Handover.
- It covers the Public Liability of both you (the Resident Owner) and
the SPASA Member Contractor to third parties in respect of personal injury,
death or damage to property arising out of or in connection with the work
being done under your SPASA Recommended Contract.
Simply said, this means that if any materials or equipment required for work are stolen or damaged on your site, or if any person is injured or killed on your site (as a result of, and during the course of Construction) both you (as the Resident Owner) and your SPASA Member Contractor are protected.

Can my contract be covered by WaterWorks?
If your swimming spa or pool is for personal private use and you have
signed a SPASA Recommended Domestic Contract with a current member of
SPASA in Queensland, your contract can be covered by WaterWorks Insurance.
How much is WaterWorks insurance cover for?
Your Contract Works cover is for the stated value of your contract
or the maximum “Insurable Value” of $150,000 (whichever
is the lesser). Your Public Liability cover is up to $10,000,000
for any one occurrence.
Can I get WaterWorks insurance from any swimming pool contractor?
NO! WaterWorks Insurance cover is only available through current members
of SPASA.
What do I do if I think I have a claim?
Immediately you become aware of any circumstance you think likely to give
rise to a claim that may be covered by your WaterWorks cover, advise Commercial
and General Insurance Brokers Pty Ltd or SPASA, in writing, as soon as
practicable.
What do I have to do to get WaterWorks insurance cover?
When you are about to sign a SPASA Recommended Contract with a SPASA member:
ask the SPASA member for a WaterWorks Insurance Request;
- ensure that the contract details on the form are complete and correct;
- ensure you sign, and your contractor signs, the WaterWorks Insurance
Endorsement;
include a cheque for the specified amount payable to Commercial and General
Insurance Brokers Pty Ltd or complete the credit card details; and
- ensure that your SPASA member contractor sends both the completed form
and the payment immediately to SPASA.
How do I confirm that Insurance Cover is in place prior to work commencing?
Contact either:
- Commercial and General Insurance Brokers on (07) 3357 1235; or
- SPASA.
